Terms of Service

1. Acceptance of Terms

By creating an account or using Kostomer ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all users, including account owners, team members and administrators.

2. The Service

Kostomer is a cloud-based CRM platform that helps businesses manage leads, customers, installations, payments, inventory and automated reminders. We reserve the right to modify, suspend or discontinue any part of the service at any time with reasonable notice.

3. Free Trial

New accounts receive a 7-day free trial with full access to all features. No credit card is required to start your trial. At the end of the trial period, your account will be restricted until you subscribe. Your data is retained for 90 days after trial expiry before being permanently deleted.

4. Subscriptions & Billing

• Payments are processed securely via Paystack
• Monthly subscriptions are billed every 30 days from the date of subscription
• Yearly subscriptions are billed annually
• All prices are in Nigerian Naira (₦) and inclusive of any applicable taxes
• Failed payments will result in account suspension after a grace period

5. Cancellation & Refunds

You may cancel your subscription at any time. Your account will remain active until the end of your current billing period. We do not offer pro-rated refunds for unused time on monthly plans. For yearly plans, refund requests made within 14 days of payment may be considered at our discretion — contact support@kostomer.com.

6. Your Data

You retain full ownership of all data you enter into Kostomer — your leads, customers, installation records and all associated information. We do not claim any rights over your business data. You are responsible for ensuring that any customer data you enter into Kostomer has been collected lawfully and with appropriate consent.

7. Acceptable Use

You agree not to use Kostomer to:

• Violate any applicable laws or regulations in Nigeria or internationally
• Send unsolicited bulk messages (spam) through our SMS or email tools
• Store, transmit or distribute malicious code or harmful content
• Attempt to gain unauthorised access to other accounts or our systems
• Resell or sublicense access to the platform without our written consent
• Use the platform in any way that could damage, disable or impair our services

Violation of these terms may result in immediate suspension or termination of your account without refund.

8. Team Members

As an account owner, you are responsible for all activity that occurs under your account, including actions taken by team members you invite. Ensure you only grant access to trusted individuals and revoke access promptly when team members leave your organisation.

9. Uptime & Service Availability

We aim to maintain high availability of the Kostomer platform but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from service interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Kostomer shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the platform, including but not limited to loss of revenue, loss of data or business interruption. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Intellectual Property

The Kostomer brand, logo, software, design and documentation are owned by us and protected by applicable intellectual property laws. You may not copy, modify, reverse-engineer or distribute any part of our platform without written permission.

12. Governing Law

These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be subject to the jurisdiction of Nigerian courts.

13. Changes to These Terms

We may update these terms from time to time. We will notify you by email at least 14 days before significant changes take effect. Continued use of the platform after that date constitutes acceptance of the new terms.
